HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.5558 of 2015 ORDER:
This criminal petition, under section 438 of the Code of Criminal Procedure, is filed by the petitioner-Accused No.4 seeking grant of anticipatory bail in connection with crime No.40 of 2015 on the file of Chengomul Police Station, Ranga Reddy District, registered for the offences punishable under Sections 323 IPC and 3 (1) (x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
Heard and perused the material available on record. The present petition is a pre-mature in nature since this Court has already granted an order in favour of the petitioner directing the respondent police to complete investigation without arresting the petitioner, in Crl.P. No.6533 of 2014 vide order, dated 18.06.2014. That order does not inform the investigating officer to arrest the petitioner after completion of investigation. Hence, this Court is of the view that the present petition is not maintainable at this stage. Accordingly, the Criminal Petition is dismissed. However, the petitioner is at liberty to approach the Court if there is any apprehension of arrest, after filing of charge sheet, seeking anticipatory bail.
