This criminal petition is filed under Section 482 Cr.P.C. seeking to quash the proceedings in D.V.C.No.16/2016 on the file of II Additional Judicial First Class Magistrate at Tanuku, registered against the petitioners, who is respondents before the trial court, for the alleged offences punishable under the provisions of the Domestic Violence Act, 2005 Heard the learned counsel for the petitioners and the learned Additional Public Prosecutor appearing for the State. A perusal of the material on record reveals that specific allegations were made against the petitioners. The truth or otherwise of the allegations can only be decided during course of trial. I see no ground to interdict at this stage and quash the proceedings.
In the facts and circumstances of the case and as requested by the learned counsel for the petitioners, the criminal petition is disposed of, directing the trial court to dispose of the case as expeditiously as possible, preferably within a period of three months from the date of receipt of a copy of this order, without insisting the presence of the petitioners, unless required for any specific purpose. However, the husband of the complainant/respondent No.2, shall appear before the trial court.
