THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.11060 of 2018 ORDER:

Heard learned counsel for the petitioner, learned Government Pleader for Panchayat Raj and Sri Ravi Cheemalapati, learned Standing Counsel.

The grievance of the petitioner in the present Writ Petition is that, despite the opinion rendered by the learned Assistant Government Pleader, and despite the legal notice, dated 11.03.2016, got issued by the petitioner herein, the SecretaryPalakoderu Gram Panchayat, West Godavari District-fourth respondent herein is not taking any action in the direction of considering the request of the petitioner herein. A copy of the opinion, dated 09.04.2015, rendered by the learned Assistant Government Pleader, is placed on record, wherein he opined that the applicant/petitioner herein has clear, valid and absolute right over the property and also indicated therein to collect the Encumbrance Certificate before taking steps for mutation. In the legal notice got issued by the petitioner herein, a request was made for mutation of the petitioner's name in the panchayat records.

Having heard the learned counsel on either side, and in the facts and circumstances of the case, this Court deems it appropriate to dispose of the Writ Petition with a direction to

the Secretary-Palakoderu Gram Panchayat, West Godavari District-fourth respondent herein to consider the case of the petitioner herein for mutation of his name in the Gram Panchayat records, strictly in accordance with law, as expeditiously as possible.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. __________________ A.V.SESHA SAI,J 18th April, 2018 Tsy
