Heard.
The petitioner states that he purchased the land admeasuring Ac.0-72 cents in R.S.No.149/3 situated at Billakurru Village, Kothapeta Mandal, East Godavari District, under a registered Sale Deed, dated 03-02-2001 and since then, he is in possession and enjoyment of the said land. The petitioner states that he intends to sell the said land and when he presented the documents before the 2nd respondent, he declined to receive the same on the ground that the said land belongs to the 3rd respondent. Accordingly, the petitioner approached the 3rd respondent, who is stated to have issued a Certificate, dated 02-04-2015 stating that the land in question does not belong to the 3rd respondent. In view of that, the petitioner seeks a direction as prayed for.
Since the 3rd respondent is stated to have issued a Certificate, it is for the 2nd respondent to receive the documents presented by the petitioner along with the said Certificate and process the same for registration in accordance with law. It is made clear that in the event the 2nd respondent is of the opinion that the document warrants refusal of registration, he shall pass appropriate orders duly recording the reasons for such refusal in accordance with Section 71 of the Registration Act.
