THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY SECOND APPEAL No.143 OF 2013 JUDGMENT:

This Second Appeal is filed, by the unsuccessful plaintiff, under Section 100 of C.P.C., assailing the judgment and decree dated 12.10.2011 passed in A.S.No.104 of 2010 on the file of the Court of the District Judge, Anantapur.

At the time of hearing, learned counsel for the appellant seeks permission of this Court to permit the appellant to withdraw the appeal with a liberty to avail the remedies available to him under law.

Permission is granted.

Accordingly, the Second Appeal is dismissed as withdrawn granting liberty as prayed for. There shall be no order as to costs. Consequently, Miscellaneous Petitions, if any, pending in this Second Appeal shall stand closed.
