HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.20369 of 2004 ORDER:
When the matter is taken up for hearing, learned counsel for petitioner submits that the petitioner has filed this writ petition seeking promotion to the post of Assistant Accounts Officer and this Court, vide orders dated 05.11.2004, granted interim directions directing the respondents to pass appropriate orders on the representation submitted by the petitioner on 20.12.2002. The learned counsel for petitioner contend that during the pendency of this writ petition, the petitioner has attained the age of superannuation. Counsel for petitioner further submits that in view of the interim orders, no further orders are necessary and if the case of the petitioner is considered for promotion, the same benefit should be extended to the petitioner in accordance with Rules.
In view of the above submission, this Court is of the considered view that in view of the interim orders granted on 05.11.2004, no further orders are necessary in the writ petition. If the case of the petitioner is considered for promotion, the same benefit should be extended to the petitioner and if the case of the petitioner is not considered for promotion, then, the petitioner is given liberty to submit a representation to the respondents within two weeks from the date of receipt of a copy of this order seeking notional benefits and notional promotion. Upon such representation being received by the respondents, the respondents shall consider the same and pass appropriate orders in accordance with Rules, within four weeks thereafter.
With these observations, the writ petition is disposed of. No order as to costs.
