O R D E R

This writ petition is filed for a writ of mandamus seeking to quash the auction notice dated 07.07.2011 and to declare the action of the 5th respondent in conducting auction to the inam lands admeasuring Ac.2.00 cents at Tallamudunrupadu, Tadepalligudem, West Godavari District, as illegal and arbitrary and for a consequential direction to the respondents not to conduct auction.

This Court granted interim stay on 15.07.2011 in respect of auction notification dated 07.07.2011.

Though the learned counsel for the petitioner raised several issues, the same is disputed by Smt K.Lalitha, learned Standing counsel for respondents 1 to 4 stating that the petitioner has challenged only impugned auction notice in the writ petition and by efflux of time, as the period specified in the impugned auction notice has expired, the cause in the writ petition no longer survives for adjudication and sought for dismissal of the writ petition. In the present case, the auction notice dated 07.07.2011 is issued for grant of lease hold rights in respect of land admeasuring Ac.2.00 cents for a period of three years. But by efflux of time, the said period has expired. As such, the cause in the writ petition does not survive for adjudication. However, it is open for the petitioner to agitate his rights as and when any fresh auction notice is issued.

Accordingly, the writ petition is disposed of. No costs. As a sequel, miscellaneous petitions pending if any, shall stand closed. ____________________________ A.RAJASHEKER REDDY,J Date: 29.09.2015 dv
