Civil Revision Petition No.807 of 2019 :

In Civil Revision Petition No.807 of 2019 the petitioners, who are defendant nos.3 and 4 in Original Suit No.44 of 2005, are aggrieved by the refusal of the Court below to permit them to mark the certified copy of the deposition of 2nd defendant, viz., Mrs. Delyse Monie, given in Original Suit No.39 of 1999 on the file of the I Additional Chief Judge, City Civil Court, Secunderabad in the evidence of D.W.1.

Sri S. Malla Rao, counsel appearing for Mrs. Delyse Monie, has filed an affidavit dt.20.08.2009, signed by the said party, stating that she has no objection for marking of the Certified Copy of her deposition given in Original Suit No.39 of 1999 on the file of I Additional Chief Judge, City Civil Court, Secunderabad as Exhibit in the evidence of D.W.1 in Original Suit No.44 of 2005 on the file of XX Additional Chief Judge, City Civil Court, Secunderabad. 3.

In this view of the matter, the Civil Revision Petition No.807 of 2019 is allowed. The order dt.12.03.2019 passed in Original Suit No.44 of 2005 is set aside, and the Court below is directed to permit petitioners to mark the Certified Copy of deposition of Mrs. Delyse Monie given in Original Suit No.39 of 1999 as exhibit in the evidence

In view of the order passed in Civil Revision Petition No.807 of 2019, the counsel for petitioner(s) in Civil Revision Petition No.5116 of 2014 do not wish to press the said Revision. 5.

Accordingly, Civil Revision Petition No.5116 of 2014 is dismissed as withdrawn. No order as to costs. 6.
