THE HON'BLE SRI JUSTICE S. V. BHATT WRIT PETITION No.10842 OF 2015 ORDER:
The petitioner prays for Mandamus directing the 2nd respondent to consider and dispose of Appeal No.4 of 2015 as expeditiously as
possible preferably within a period of four weeks from today. Learned Government Pleader for Revenue does not contest the prayer for disposal of the appeal, but submits that prescription of time requested by the petitioner in a case where the appeal is filed in the year 2015 may cause undue pressure on the 2nd respondent.
Having taken note of the submissions made by the learned counsel and without expressing any view on the merits of the matter, the 2nd respondent is directed to consider and dispose of the appeal on merits in accordance with law preferably within a period of four months from the date of receipt of a copy of this order. The Writ Petition is accordingly disposed of. No order as to costs. Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
