THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.3978 OF 2016 ORDER:

This criminal petition, under Section 439 (1) (b) read with Section 482 of the Code Of Criminal Procedure, 1973 (for short 'Cr.P.C.'), is filed by the petitioner/ sole accused to relax the condition imposed in Crl.M.P. No.51 of 2018 in POSCO SC No.54 of 2016 by an order dated 02.02.2018 by the I Additional District and Sessions Judge, East Godavari District at Rajamahendravaram, whereby the petitioner was directed to execute personal bond for Rs.25,000/- with two sureties for a like sum each to the satisfaction of that Court. The contention of the petitioner is that he is a coolie and not in a position to execute a personal bond for a sum of Rs.25,000/- with two sureties and prayed to reduce the surety amount. As seen from the record, the offence allegedly committed by the petitioner is punishable under Section 376 (2) (i) IPC and Section 5 (l) (m) read with Section 6 of POCSO Act, 2012 and is a serious offence against society. However, taking into consideration of the financial condition of the petitioner, the surety amount is reduced to Rs.20,000/- from Rs.25,000/-.
