THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.9733 of 2017 ORDER:
The case of the petitioner is that one Sri D.Ravinder, who is working as a Supervisor under him, lodged a written complaint to the second respondent on 11.02.2017 against some persons and the same was registered as FIR No.28 of 2017. It is his further case that the third respondent, as a counter blast to the said complaint, lodged another complaint on 11.02.2017, wherein the petitioner was shown as one of the accused. The said complaint was registered as FIR No.27 of 2017. Challenging registration of the complaint against the petitioner, the present Writ Petition is filed. A reading of the complaints discloses that there was some interference, but the name of the caste was used. Since the matter is under investigation, this Court is not inclined to interfere with the investigation process. However, the second respondent is directed to continue the investigation without arresting the petitioner as well as the accused in the other case, since it is noticed that in the other case also the name of the caste was used for lodging the complaint.
In the circumstances, the notice to the third respondent is dispensed with.
The Writ Petition is, accordingly, disposed of giving liberty to the second respondent to continue the investigation in Crime
Nos.27 and 28 of 2017 without arresting the accused in both the cases. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs.
