THE HON'BLE SRI JUSTICE SANJAY KUMAR AND THE HON'BLE SRI JUSTICE M. SEETHARAMA MURTI WRIT PETITION NO.15468 of 2014 O R D E R: (per Hon'ble Sri Justice Sanjay Kumar) The Union of India and the Railway authorities filed this writ petition aggrieved by the order dated 30.08.2013 passed by the Central Administrative Tribunal, Hyderabad Bench, in OA.No.1278 of 2011. The said O.A was filed by the 1st respondent herein challenging the penalty of compulsory retirement from service imposed upon him. By the order dated 30.08.2013, the Tribunal set aside the said punishment and directed the revisional authority to reconsider the penalty to be levied upon the 1st respondent/applicant other than compulsory retirement.

By order dated 13.06.2014, this Court granted interim suspension of the order under challenge.

While so, the 1st respondent/applicant filed an affidavit before this Court stating that he is willing to accept the punishment of compulsory retirement imposed upon him.

Ms. Anuradha, learned counsel appearing for the 1st respondent/applicant, states that as the 1st respondent/applicant wishes to accept the punishment imposed upon him, he may be permitted to withdraw OA.No.1278 of 2011 wherein he was granted relief. In the light of the afore-stated circumstances, the Writ Petition is allowed setting aside the order dated 30.08.2013 passed by the Central Administrative Tribunal, Hyderabad Bench, in OA.no.1278 of 2011 and OA.No.1278 of 2011 is dismissed as withdrawn. Pending Miscellaneous Petitions shall also stand dismissed. No order as to costs.
