THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.11081 of 2018 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking verbatim the following relief: "For the reasons stated in the accompanying affidavit, it is prayed that this Hon'ble high court may be pleased to issue an appropriate writ, order or direction, more particularly one in the nature of writ of Mandamus or any other appropriate writ directing the 3rd Respondent to consider the complaint dt.1903-2018, thereby, seeking to protect his life whenever petitioner goes to Devavaram village as well as in his ancestral property by taking personal bonds under Cr.P.C. from the unofficial Respondents by declaring 3rd Respondent inaction is being violation of Articles 14 and 21 of the Constitution of India and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case." 2.

I have heard the submissions of Sri Ramana Allu, learned counsel appearing for the petitioner, and of the learned Government Pleader for Home (A.P.) appearing for the respondents 1 to 3. I have perused the material record.

Learned counsel for the petitioner would submit that as of now, no civil proceedings are pending between the petitioner and unofficial respondents and that in this writ petition, the only direction sought is to consider the representation, dated 19.03.2018, which is given seeking protection to the life of the petitioner.

Learned Government Pleader for Home, on written instructions, dated 06.04.2018, a copy of which is placed on record, would submit that on the representation afore-stated of the petitioner, a case in Crime No.33 of 2018 was registered by the

MSRM, J W.P.No.11081 of 2018 Station House Officer, Nakkapalli Police Station, Visakhapatnam District, on 05.04.2018, under Section 107 of the Code of Criminal Procedure, 1973, against the unofficial respondents and necessary information was laid before the Mandal Executive Magistrate, Nakkapalli, 05.04.2018, for appropriate further proceedings and action and the matter is now pending with the Mandal Executive Magistrate, Nakkapalli.

Learned counsel for the petitioner, in reply, submitted that the writ petition may be disposed of recording the afore-stated submissions of the learned Government Pleader for Home. 6.

Recording the submissions, the Writ Petition is, accordingly, disposed of. There shall be no order as to costs. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order.
