Mothukuri Ganesh v. The Chairman And Managing Director,
HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 41754 of 2015 ORDER:
Heard Sri S.Sreenivasa Sharma, learned counsel appearing for the petitioners and Sri J.Sreenivasa Rao, learned Standing Counsel appearing for respondent Nos.1 to 3 and Government Pleader for Labour and Employment for respondent No.4.
The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents in not considering the representation dated 30.07.2015 made by the petitioners for providing any employment in respondent Nos.1 to 3 company in any suitable or eligible post basing upon their education qualification, as illegal, arbitrary and violation of Articles 14, 16 and 21 of the Constitution of India; and consequently direct the respondents to consider their representation dated 30.07.2015.
Though various grounds are raised in the writ petition, learned counsel for the petitioners restricts his prayer seeking a direction to the respondent authorities to consider the representation dated 30.07.2015 made by the petitioners, seeking employment basing on their educational qualification.
Learned Standing counsel for the respondent Nos.1 to 3 though opposed the same, but however submits that the same may be directed to be considered in accordance with law.
Without going into the merits of the case and having regard to the submissions made, the writ petition is disposed of at the admission stage, directing the respondents to consider the representation dated 30.07.2015 and pass orders in accordance with law, at the earliest, preferably within a period of four (04) weeks from the date of receipt of a copy of the order. There shall be no order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
