THE HON'BLE JUSTICE G.SRI DEVI CRIMINAL PETITION No.3588 of 2019 ORDER:

This Criminal Petition, under Section 482 of Cr.P.C., is filed by the petitioners/A-1 to A-4 seeking to quash the proceedings in C.C.No.823 of 2017 on the file of the learned I Additional Chief Metropolitan Magistrate, Nampally, Hyderabad. 2.

Heard learned counsel for the petitioners/A-1 to A-4, learned Additional Public Prosecutor representing the 1st respondent-State and perused the record.

Learned counsel for the petitioners submitted that the petitioners have not even seen respondent No.2 at any point of time and they have no role to play in her life as they have disowned their own son and he has been staying separately since a long time and as such, the registration of crime against the petitioners is illegal and the present charge sheet is filed only to harass the petitioners. Hence, the learned counsel prayed to quash the aforesaid proceedings against the petitioners.

Learned Additional Public Prosecutor opposed to quash the proceedings in the aforesaid C.C.

The truth or otherwise of the allegations levelled against the petitioners can only be decided during the course of trial. This Court is not supposed to make a roving enquiry into the allegations made in the charge sheet. Hence, this Court does not find any valid ground to quash the proceedings in the aforesaid C.C. and the prayer to quash the proceedings in the said C.C. is rejected. However, in view

of the prayer made by learned counsel for the petitioners to dispense with the appearance of the petitioner before the Court below, the appearance of the petitioners before the Court below is dispensed with, except on the dates whenever their presence is specifically required by the trial Court and they shall be represented by a counsel. 6.

Accordingly, the Criminal Petition is disposed of. 7.

Miscellaneous petitions, if any pending in this criminal petition, shall stand dismissed.
