This petition is filed under Section 24 of C.P.C. seeking to withdraw I.D.O.P.No.593 of 2016 from the file of the District Court, Krishna at Machilipatnam, and transfer the same to the file of the Principal District Court, Eluru, West Godavari District. 2.

Heard the learned counsel for both parties.

A perusal of the record reveals that the marriage of the petitioner was solemnized with the respondent on 16.10.2014 at Palakollu, as per Christian Rites and Caste Customs. Immediately after the marriage, the petitioner joined the respondent to lead marital life. For one reason or other, disputes arose between the petitioner and respondent; therefore, the petitioner has been residing at her parents' house in Palakollu, West Godavari District. Basing on the complaint lodged by the petitioner, the Station House Officer, Palakol Town Police Station, registered a case in Crime No.23 of 2017 against the respondent for the offences punishable under Section 498-A I.P.C. and Sections 3 and 4 of Dowry Prohibition Act. A perusal of the record reveals that C.C.No.111 of 2017 is pending on the file of the Court of the Additional Judicial First Class Magistrtae, Palakol. 4.

It is the case of the petitioner that she is facing much difficulty to travel from Palakollu to Machilipatnam in order to prosecute I.D.O.P.No.593 of 2016.

At the time of arguments, learned counsel for both parties submitted that Eluru is the center point for both the parties. 6.

Having regard to the facts and circumstances of the case, the Transfer Civil Miscellaneous Petition is allowed. I.D.O.P.No.593 of 2016 is withdrawn from the file of the District Court, Krishna at Machilipatnam, and transferred to the file of the Principal District Court, Eluru, West Godavari District, for disposal in accordance with law. There shall be no order as to costs. 7.
