HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.13309 of 2019 ORDER:

This writ petition is filed seeking the following relief :- " ..... to issue an appropriate Writ, order or Direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondent No 1 in not passing orders on the appeal filed by the petitioner on 13.5.2019 against the letter Nos.84 and 85 of the 2nd respondent dt.4.2.2019 as being illegal, arbitrary and unjust ......" Heard Smt.A.Varalakshmi, the learned counsel for petitioner and the learned Government Pleader for Labour. It has been contended by the petitioner that he is a retired Superintendent and worked with the 2nd respondent. He has incurred medical expenses of Rs.35,914/ -. Therefore, he has submitted a representation to the 2nd respondent on 04.03.2019 requesting to reimburse the medical expenses incurred by him to a tune of Rs.35,914/ -.

But, the 2nd respondent has rejected the case of the petitioner vide letter dated 04.05.2019. Aggrieved thereby, the petitioner has preferred an appeal before the 1st respondent on 13.05.2019. But, the 1st respondent has not passed any orders on the appeal preferred by the petitioner.

The learned counsel for the petitioner submits that appropriate orders be passed in the writ petition directing the 1st respondent to consider the appeal preferred by the petitioner on 13.05.2019 and pass appropriate orders in accordance with law. The learned Government Pleader appearing for the respondents has contended that the appeal preferred by the

petitioner will be considered and appropriate orders would be passed by the 1st respondent in accordance with law. This Court, having considered the rival submissions of the learned counsel for the respective parties, is of the considered view that this writ petition can be disposed of directing the 1st respondent to consider the appeal preferred by the petitioner on 13.05.2019 and pass appropriate orders in accordance with law within a period of eight weeks from the date of receipt of a copy of this order.

With the above observations, the writ petition is disposed of. No order as to costs.
