There is no controversy between the learned counsel for the petitioners and learned Government Pleader for Irrigation that the issue involved in this writ petition is squarely covered by the orders of this Court in WP.No.10658 of 2014 and batch dated 17.10.2014, which in turn followed the earlier decision of this Court in WP.No.34439 of 2012 dated 31.01.2013.
Consequently, following the aforesaid order, the writ petition is allowed. The respondents shall, therefore, consider the case of the petitioners for extending the benefit under the Rehabilitation and Resettlement Policy notified by the Government in G.O.Ms.No.68 Irrigation and CAD (Project Wing-LA-IV-R & R) Department dated 08.04.2005 and take further appropriate consequential action.
As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
