HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P.No.348 of 2016 ORDER:

This petition is filed to withdraw F.C.O.P.No.17 of 2016 from the file of Family Court-cum-IV-Additional District Judge, Kurnool, and transfer the same to Family Court, Anantapur, to be tried along with F.C.M.C.No.9 of 2016.

2. Wife filed this petition. According to her affidavit, her marriage with respondent was solemnized on 01.04.2010 at Anantapur as per Hindu custom and tradition. She stated that during their wedlock they were blessed with a child, who is now five years old, and due to harassment from respondent, petitioner is residing at her parents house. She stated that respondent filed F.C.O.P.No.17 of 2016 before Family Court, Kurnool, for divorce and it is difficult for her to travel from Anantapur to Kurnool with five years old child. She stated that she filed M.C.No.9 of 2016 before Family Court, Anantapur, and in order to harass her respondent filed F.C.O.P.No.17 of 2016 at Kurnool. She further stated that her convenience is paramount consideration for transfer, therefore, she prayed for transfer of F.C.O.P.No.17 of 2016 from Family Court, Kurnool, to Family Court, Anantapur.

3. Respondent in spite of service of notice neither appeared in person nor through any advocate.

4. Heard advocate for petitioner.

5. Considering the reasons stated in the affidavit, and also considering the convenience of wife, F.C.O.P.No.17 of 2016 is withdrawn from Family Court, Kurnool, and transferred to Family Court, Anantapur, for disposal in accordance with law.

6. Transfer C.M.P. is ordered accordingly.

7. Miscellaneous petitions pending, if any, shall stand closed.
