THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.2474 of 2017 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking the following relief: "to declare the action on part of the Collector & District Magistrate, Prakasam, Ongole in not passing the orders in revision/stay petition filed by the petitioner in the revision preferred against the orders of the Collector (CS) Prakasam, Ongole dt.21.10.2016, as illegal and arbitrary." Heard Sri I.Gopala Reddy, learned counsel for the petitioner and the learned Government Pleader for Civil Supplies for the respondents.
It is submitted by the learned counsel for the petitioner that pending appeal before the 3rd respondent-Joint Collector, the petitioner herein is operating the fair price shop by virtue of the orders passed by this Court in W.P.No.22450 of 2016, dated 14.07.2016.
Since statutory revision filed by the petitioner is pending before the 2nd respondent-District Collector, this Court is not inclined to go into the merits of the case.
Having regard to the submissions made by the learned counsel for the petitioner herein and the learned Government Pleader for the respondents, this Court deems it appropriate to dispose of the writ petition with a direction to the 2nd respondent-
District Collector to dispose of the revision filed by the petitioner by fixing the time frame and by suspending the order of cancellation dated 20.05.2016 till then.
For the aforesaid reasons, this writ petition is disposed of directing the 2nd respondent-District Collector to dispose of the revision filed by the petitioner within a period of two months from the date of receipt of a copy of this order. Till the said exercise attains finality, the order of cancellation dated 20.05.2016 shall remain suspended. There shall be no order as to costs. The Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
