HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.39939 of 2016 ORDER:

The present writ petition is filed by the petitioner under Article 226 of the Constitution of India, seeking a direction to 4th and 5th respondents to investigate into Crime No.673 of 2016 and file a charge-sheet.

The main grievance of the petitioner is that the complaint filed by her before the 4th respondent against the unofficial respondent, who, according to the petitioner, misappropriated the amounts of the firm and the profits derived from the partnership business and forged the signatures of the partners by deleting their names from the firm. But the police did not choose to conduct investigation. Heard and perused the material available on record. Considering the facts and circumstances of the case and the grievance of the petitioner, without expressing any opinion on merits, respondents Nos.4 and 5 are directed to conduct investigation in the above crime, complete the same and file the charge-sheet, as expeditiously as possible, more preferably within a period of six months from today.

With the above direction, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
