The writ petition was filed challenging the proceedings dated 28.02.2009 appointing the second respondent as Superintendent Engineer (Civil) and there was no interim order while admitting the writ petition. The petitioner was aged about 56 years when he filed the writ petition. In view of passage of time, the cause of action does not survive. The writ petition is accordingly dismissed as infructuous.
