Mohammad Abdul Moid v. The Telangana State Council For Higher Education,
HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT APPEAL No. 266 OF 2016 18-04-2016 Between:
Mohammed Abdul Moid ... Appellant And The Telangana State Council for Higher Education, Opposite Mahavir Hospital, Mahavir Marg, Road No.1, Masab Tank, Hyderabad, rep., by its Secretary and others ... Respondents
HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT APPEAL No. 266 OF 2016 PC: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Heard learned counsel for the parties.
The order impugned in the present writ appeal reads thus: "Though this Court granted interim orders in other similar cases, the equivalency certificate produced by the petitioner reflects cause for suspecting the genuineness thereof. Admittedly, the High School Diploma Course offered by the Northwest Accreditation Commission is four years in duration.
The petitioner passed his SSC examination in March, 2010. He would therefore have completed the four year high school diploma course offered by the Northwest Accreditation Commission in 2014. However, the certificates produced by him reflect that he completed the high school diploma course in 2012-2013 itself. This being so, an interim order cannot be granted at this stage permitting the petitioner to continue his further studies.
The WPMP is accordingly dismissed."
In view of the observations made in the order and in view of the appellant's claim that he did the High School Diploma Course offered by the Northwest Accreditation Commission after passing ninth standard examination, we asked learned counsel for the appellant to demonstrate that he took admission after ninth standard, but he could not and did not point out from the materials placed on record. In view thereof, we find no merit in the writ appeal. Writ appeal is dismissed.
Miscellaneous petitions, if any, also stand disposed of. _________________________ DILIP B. BHOSALE, ACJ ________________________ P. NAVEEN RAO, J 18-04-2016 ks
