Smt.Ghousia Begum ..Petitioner And The State of Telangana, represented by its Chief Secretary, Department of Home, Secretariat Buildings, Hyderabad and others ..Respondents Counsel for the petitioner: Mr.P.Vamsheedhar Reddy Counsel for the respondents: Government Pleader for Home (TS) The Court made the following:
CVNR, J & MSKJ, J W.P.No.27107 of 2016 ORDER: (Per the Hon'ble Sri Justice C.V.Nagarjuna Reddy) This writ petition is filed for issue of habeas corpus for releasing Mr.Mohd.Abdul Parwez @ Shaik Mohd.Abdul, S/o late Rajjaque - the husband of the petitioner (hereinafter referred to as 'the detenu'), after quashing G.O.Rt.937, General Administration (Law & Order) Department, dated 29.04.2016, issued by respondent No.1.
2.
From the facts of the case, it is evident that the detenu was detained as far back as 11.02.2016 and that he has served detention for almost 11 months.
3.
Mr.P.Vamsheedhar Reddy, learned counsel for the petitioner, has submitted that out of seven criminal cases referred to in the detention order, dated 11.02.2016, passed by respondent No.3, four criminal cases ended in acquittal/compromise and that only three cases are pending against the detenu.
4.
In the light of the above facts, we are of the opinion that this is a fit case to quash the detention order.
5.
In the result, the Writ Petition is allowed and the impugned detention order, dated 11.02.2016, passed by respondent No.3, which was confirmed by respondent No.1, vide G.O.Rt.937, General Administration (Law & Order) Department, dated 29.04.2016, is set aside. The detenu - Mohd.Abdul Parwez @ Shaik Mohd.Abdul, S/o late Rajjaque is directed to be released from the detention forthwith, if he is not required in any other criminal case(s).
