THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.22622 of 2016 ORDER:

The petitioner was appointed as Junior Lineman on 01.08.1995 and he worked at Kakinada up to 17.11.2004. He was transferred to ITDA area, Tekkali, on 18.11.2004 and worked up to 20.06.2006. Thereafter he was transferred to Amalapuram on 21.06.2006 as Additional Assistant Engineer and worked up to 15.06.2008. Thereafter several transfers took place and ultimately when he was working in Nidadavolu he was transferred to Seethampeta (agency area) by orders dated 30.06.2016. The petitioner challenged the same in W.P.No.21909 of 2016. This Court passed an order on 05.07.2016 granting status quo for a period of two weeks. The said order has been in force as of now. While so, when a Memo was issued on 06.07.2016 for his alleged absence at 15.00 hrs on 05.07.2016, the present Writ Petition is filed. Learned Counsel for the petitioner submits that the present memo is issued only to threaten and misinterpret the orders of status quo granted by this Court in order to nullify the effect of the orders. He further submits that a Contempt Case is also filed for violating the orders of status quo.

However, since the present proceedings are only the proceedings calling for explanation from the petitioner, this Court is not inclined to interfere with the same, but disposes of the Writ Petition giving liberty to the petitioner to submit his explanation to the impugned Memo dated 06.07.2016 on or before 18.07.2016. Learned Counsel for the petitioner undertakes to communicate this order to his client in order to enable him to submit the explanation.

The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
