HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO W.P.No.16391 of 2017

ORDER

Heard learned counsel appearing for the petitioner and learned Government Pleader for Civil Supplies appearing for respondents 1 to 5.

No counter is filed even after giving sufficient opportunity to the respondents.

The petitioner is native of Mallampet Village, Kotapalli Mandal, Adilabad District, presently Mancherial District. He was appointed as fair price shop dealer in the year 1985 and allotted shop No.10 of Mallampet Village. The authorization of the petitioner was due for renewal in March, 2017. But, the 4th respondent vide order dated 19.11.2016 suspended the authorization of the petitioner on the ground of his involvement in an atrocity case. The petitioner submitted a representation to the 3rd respondent on 7.3.2017 and on 20.03.2017 to the 4th respondent.

It appears that 6-A proceedings are also pending against the petitioner. But pendency of 6-A proceedings have nothing to do with the regular enquiry to be conducted by the 4th

respondent. Even after issuance of the order of suspension on 19.11.2016, no show cause notice appears to have been issued to the petitioner.

In the circumstances, if the 4th respondent wants to take further action, appropriate proceedings shall be initiated and the same shall be completed within four months. If the 4th respondent does not want to issue any show cause notice, the renewal of authorization of the petitioner shall be considered subject to payment of required amount by the latter and appropriate orders shall be passed in this regard. Accordingly, the Writ Petition is disposed of. No costs.
