HON'BLE SMT JUSTICE T.RAJANI CRIMINAL PETITION No.8711 of 2011 ORDER:

This Criminal Petition is filed seeking quashing of the proceedings in P.R.C.No.14 of 2010 on the file of First Additional Junior Civil Judge, Tenali.

Heard the learned counsel for the petitioner, learned Public Prosecutor (AP) for respondent No.1 and learned Counsel for respondent No.2.

Learned counsel for the petitioner contends that, except the allegation that the petitioner - A.8 shouted that the complainant should be killed, there are no other allegations against him.

In the considered opinion of this Court, the said allegation would suffice to infer that there is conspiracy between the petitioner and other accused. The role of the petitioner, and his intention in uttering those words, has to be gone into at the time of trial.

Hence, this Court opines that this is not a fit case for quashing the proceedings in P.R.C.No.14 of 2010 on the file of First Additional Junior Civil Judge, Tenali.

The Criminal Petition is, accordingly, dismissed. Miscellaneous Petitions pending, if any, shall also stand disposed of.
