THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION NO.15446 OF 2015 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for respondents. Notice to respondent Nos.6 and 7 is dispensed with in view of the relief granted in the present writ petition.

The petitioner and his family members own wet land to an extent of Acs.8.33 cents in R.S.Nos.311/4, 312/1A and 1B, 312/1B, 2A and 2B and 312/3 of Saripalle in Gopavaram Village of Uppalaguptam Mandal of East Godavari District. On the western side of the said property, the property of respondent Nos.6 and 7 is situated in an extent of Acs.3.37 cents and 0.61 cents respectively. They have converted their agricultural land for carrying prawn culture and the petitioner sent legal notice on 28.04.2015 requesting respondent Nos.2 to 5 to stop the un-authorized activity by respondent Nos.6 and 7 and the same was not considered. Hence, the present writ petition is filed.

In the circumstances, the writ petition is disposed of directing respondent Nos.2 to 5 to consider the representation submitted by the petitioner through his advocate on 28.04.2015 and pass appropriate orders in accordance with law within a period of 30 days from the date of receipt of a copy of the order. If respondent Nos.2 to 5 chose to pass an adverse order in the interest of respondent Nos.6 and 7, they should also be heard before passing an order. Accordingly, the writ petition is disposed of. No costs. Miscellaneous petitions, if any, pending shall stand closed.
