THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.1829 OF 2016 ORDER:

The petitioner/A.1 has preferred the present criminal revision case by invoking the provisions under Sections 397 and 401 of Code of Criminal Procedure (Cr.P.C.,) being aggrieved by the Order dated 24.06.2016 passed in Crl.M.P.No.2439 of 2015 in C.C. No.452 of 2014 by the Court of the Additional Judicial First Class Magistrate, Ramachandrapuram, East Godavari District, wherein the learned Magistrate dismissed the petition filed by the petitioner herein seeking to discharge him in the C.C.No.452 of 2014, arising out of offence under Section 420 IPC read with Section 34 IPC. Heard and perused the material available on record.

After arguing for some time by the learned counsel for the petitioner, when this Court expresses its opinion that this Court is not inclined to interfere with the order passed by the Court below, he confined his arguments with regard to dispense with the presence of the petitioner before the Court below. Considering the nature of allegations and also as the question of identity of the petitioner/A.1 does not arise, and also considering the fact that the petitioner is a lady, the presence of the petitioner/A.1 before the trial Court is dispensed with except on the dates when the trial Court insists for her appearance.

The Criminal Revision Case is accordingly disposed of. Consequently, the miscellaneous petitions pending in this petition, if any, shall stand closed. _____________________ JUSTICE RAJA ELANGO 14.07.2016 pln
