M/S.Garvee Granites Ltd.(In Liqn.) v. The Deputy General Manager

THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM COMPANY APPLICATION No. 52 OF 2019 O R D E R:

This Application was taken out under Section 457(1)(e), 460(4), 530 & 555 of the Companies Act, 1956 read with Rules 9,168,275, 276 and 290 of the Companies (Court) Rules, 1959 for the relief (1) to (11) detailed therein.

Heard learned counsel for the Official Liquidator and perused the affidavit filed in support of the Application. So far as prayer 2 is concerned, the Official Liquidator shall move a separate Application.

Insofar as relief 1, 3, 4, 5, 6, 7, 8 and 10 are concerned, inasmuch as adjudication of claims / determination of the amounts payable to the respondents has already been done, the amounts lying in the account of the company in liquidation deserves to be distributed to the creditors. Accordingly, the above reliefs are ordered. The Official Liquidator to take necessary steps and file the compliance report.
