THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION NO.13347 OF 2019 ORDER:

The petitioner filed this Writ Petition with the following prayer:- "...to issue any writ, order or direction more particularly one in the nature of Writ of Mandamus declaring action of the respondent No.5 in pressurizing the petitioner to settle the civil/financial disputes with the unofficial respondents at the behest of the unofficial respondent as illegal, arbitrary, contrary to law and in violation of Articles 14 and 21 of Constitution of India and consequently, direct the respondent No.5 not to pressurize the petitioner to settle the civil/financial disputes with the unofficial respondents and to pass such other order or orders as this Hon'ble Court deems fit, just and proper in the circumstances of the case."

Learned Assistant Government Pleader for Home produced written instructions stating that the petitioner is involved in Crime No.130 of 2019 under Sections 420 and 506 of the Indian Penal Code (IPC) and Crime No.277 of 2019 under Sections 420 and 504 read with Section 34 IPC of Pahadishareef Police Station. It is denied that the respondent-police called the petitioner to the Police Station on 30.05.2019 and forced him to settle the issue with the unofficial respondents. The petitioner himself went to the Police Station on 30.05.2019 to surrender before the Station House Officer for obtaining bail, as per the orders of the IV Additional Metropolitan Sessions Judge, L.B. Nagar, vide Crl.M.P.No.2259 of 2019 pertaining to Crime No.130 of 2019. As such, he was remanded to judicial custody with regard to Crime No.277 of 2019, as there is a chance of tampering the evidence and threatening the

witnesses. It is further stated that the fifth respondent never pressurized the petitioner to settle the civil disputes with the unofficial disputes nor interfered with the civil matters of the petitioner.

Recording the same, this Writ Petition is disposed of directing the respondents not to interfere with the life and liberty of the petitioner except in accordance with law. However, it is made clear that this order does not preclude the respondents from investigating and proceeding with the cases registered against the petitioner. There shall be no orders as to costs.
