HON'BLE SRI JUSTICE U. DURGA PRASAD RAO Crl.P.M.P.No.1133 of 2015 in Crl.P.No.14926 of 2014 and Criminal Petition No. 14926 of 2014 COMMON ORDER:
The de-facto complainant and his counsel Sri M.A.H.Amjad are present. Accused and their counsel Sri M.A.K.Mukheed are present. On the report given by de-facto complainant the police of Punjagutta PS, Hyderabad registered FIR No.53 of 2013 against the accused for the offences under Sections 143, 144, 147, 149, 427 r/w 149 IPC and laid charge sheet and learned XIV Additional Chief Metropolitan Magistrate, Hyderabad took cognizance of the same and registered as C.C.No.2263 of 2013. Now, the parties submitted that at the intervention of elders they have amicably settled their disputes and as such permission may be accorded to them to compromise the case and record the compromise and consequently proceedings in C.C.No.2263 of 2013 may be quashed.
Having regard to the above said submission and considering the fact that it is a property case and offences charged are not grave one and also considering the fact that parties have amicably settled the disputes and no useful purpose will be served even if the parties are driven to trial, and following the decision reported in Gian Singh v. State of Punjab and another[1] the proceedings in C.C.No.2263 of 2013 on the file of XIV Additional Chief Metropolitan Magistrate, Hyderabad are hereby quashed. In the result, both the petitions are accordingly allowed. As a sequel, miscellaneous petitions pending, if any, shall stand closed. _________________________ U. DURGA PRASAD RAO, J Date: 16.02.
