THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI Civil Revision Petition No.1775 of 2016 ORDER:

This civil revision petition, under Article 227 of the Constitution of India, is filed by the petitioners/respondents in I.A.No.75 of 2016 in O.S.No.91 of 2015 on the file of the Special Assistant Agent to Government & Sub-Divisional Magistrate (Mobile Court), Bhadrachalam, contending that despite filing their written arguments in the above interlocutory application, the learned Sub Divisional Magistrate, Bhadrachalam, having granted an interim order on 23.06.2015 in favour of the respondents herein, is not disposing of the matter and is simply granting time for the written arguments of the respondents herein.

The learned counsel would submit that the subject matter is a garden consisting of jeedi mamidi trees (cashew trees) and that though the revision petitioners are in possession and the crop is ripe for harvesting, in view of the orders, which are being illegally continued, the police are not allowing either of the parties to harvest the crop and that, therefore, the revision petitioners are being put to serious and irreparable loss.

At the time of hearing, the learned counsel for the revision petitioners would further submit that a direction to dispose of the interlocutory application at the earliest may be given to the Court below in the interests of justice.

Having regard to the submissions, this Court is satisfied that ends of justice would be met if the revision petition is disposed of at the admission stage giving appropriate directions to the learned Magistrate keeping in view the law and order problem that may arise if any further delay is caused in the disposal of the said application.

5. In the result, the Civil Revision Petition is disposed of at the stage

of admission with a direction to the learned Special Assistant Agent to Government & Sub-Divisional Magistrate (Mobile Court), Bhadrachalam, to dispose of I.A.No.108 of 2015 in O.S.No.91 of 2015, as expeditiously as possible, preferably within a period of 15 days from the date of receipt of a copy of this order. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in the civil revision petition shall stand closed.
