Heard learned counsel for the petitioner and learned Standing Counsel for the A.P.Housing Board Corporation.
The present Writ Petition came to be filed seeking issuance of writ of Mandamus declaring the action of the respondents in interfering with the peaceful possession and enjoyment of the property, without following due process of law, as illegal and arbitrary and consequently direct the respondents to regularize the possession and enjoyment of the house bearing H.NO.12260/1, Housing Board Colony, Kadapa as per the guidelines framed by the Government.
Learned counsel for the petitioner mainly submits that the petitioner's mother by name K.Noorajahan was allotted house bearing No.121/LIGI, admeasuring 135 square yards at A.P.Housing Board Colony, Kadapa and she claims to be in possession of an adjacent open land admeasuring 125 square yards. It is the case of the petitioner that the Housing Board Corporation is not allotting the said land to the petitioner in terms of G.O.Ms.No.6, dated 29.03.2011. On the contrary, learned Standing Counsel for A.P.Housing Board Corporation strenuously opposes the application stating that the petitioner has no right to claim over the said land as she has sold away her property to one U.Srinivas Rao, S/o.U.Narasimhulu vide registered document No.6092, dated 16.10.2002. But, however, no documents are filed in support of the same.
At this stage, the learned counsel for the petitioner restricts his prayer seeking a direction to the respondents to consider the request made by the petitioner from time to time seeking allotment of the said land.
