HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 34114 of 2017 ORDER:

A direction is sought to respondent No.1 to activate the facility of 'Online Transaction' enabling payment of gratuity and provident fund of employees of petitioner - College to respondent No.2 and profession tax of employees to respondent No.3.

Heard the learned Counsel for the petitioner. As can be seen from the material placed on record, the brother of the deponent of the writ petition, Sri Devarakonda Satish, filed O.P.No.1570 of 2016 before XI Additional Chief Judge, City Civil Court, Hyderabad, with respect to Devarakonda Educational Society. The bank endorsement discloses that, on account of the letter given by the brother of the deponent of the writ petition, online account transactions has been frozen. Though learned counsel for the petitioner submits that what all the petitioner is seeking is only a direction to State Bank of India to activate the facility of online transaction to the extent of payment of statutory dues, like provident fund and professional tax.

Considering the fact that O.P.No.1570 of 2016 is pending before the XI Additional Chief Judge, City Civil Court, Hyderabad, interest of justice would be served if an

opportunity is given to the petitioner to seek remedies before appropriate forum either by moving an application in O.P.No.1570 of or by initiating independent proceedings.

As and when petitioner moves such application, the Civil Court shall pass orders expeditiously keeping in view that they are seeking payment of statutory dues only.

Subject to the above observations, the Writ Petition stands disposed of.

Miscellaneous Petition pending, if any, shall also stand dismissed. However, in the circumstances, without costs.
