HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.15444 OF 2017 ORDER:

The writ petition is filed by the petitioner declaring the action of respondents, in seizing. 9910 Kgs. jaggery on 02.01.2017, as being illegal and arbitrary.

Petitioner states that, during the course of business, he purchased 9910 Kgs. jaggery. He states that respondent Nos.3 to 6 visited the business premises and seized 9910 Kgs. jaggery and registered a case in COR.No.3 of 2017. He seeks a mandamus for release of the seized stock. Heard the learned counsel for the petitioner and the learned Government Pleader for Prohibition and Excise (TG). Having considered the submissions made on either side, the Writ Petition is disposed of with a direction to respondent No.2 to release the seized stock subject to the petitioner furnishing a Fixed Deposit Receipt for a sum of Rs.3.00 lakhs (Rupees Three Lakhs Only) in his favour. It is, however, made clear that release of the stock shall be subject to the final orders that may be passed by the second respondent.
