HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:

Petitioner claims to have purchased agricultural land to an extent of Ac.9.32 guntas in Sy.No.263/35 of Aroor village, Sadasivpet Mandal, Sanga Reddy district, by way of registered sale deed dated 01.06.2015. Petitioner applied to mutate his name in the revenue records. By letter dated 02.03.2019 addressed to the Revenue Divisional Officer, Sangareddy, the Tahsildar informed that request of petitioner to mutate his name cannot be accepted as subject land was assigned to the vendor of applicant and, therefore, sale is not valid. According to learned counsel for petitioner, said copy was also furnished to the petitioner. Aggrieved thereby, petitioner filed representation to the Revenue Divisional Officer on 16.04.2019. According to the learned counsel for petitioner, so far no decision is made. Hence, this Writ Petition challenging the decision of Tahsildar contained in letter dated 02.03.2019.

2.

Since remedy of appeal is available and representation is already made, Court is not inclined to entertain the Writ Petition. However, learned Assistant Government Pleader points out that appeal is not made in a proper form, but it is submitted in the form of representation, and same is not permissible and the petitioner may be directed to file appeal in a proper form. 3.

Having regard to these submissions, liberty is granted to the petitioner to prefer an appeal in a proper form within a period of two weeks from today. On filing of such appeal, having regard to

the representation made on 16.04.2019, the appellate authority shall consider the same on merits and pass appropriate orders within a period of eight weeks from the date of receipt of copy of appeal in a proper form.

4.

Writ Petition is accordingly disposed of.

Pending miscellaneous petitions shall stand dismissed. ___________________________ JUSTICE P.NAVEEN RAO kkm
