THE HON'BLE DR. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.9067 OF 2017 ORDER:
Heard learned counsel for the petitioner/accused, learned Additional Public Prosecutor for the respondent State and perused the record.
This petition is filed under Section 482 Cr.P.C. to quash the proceedings in C.C.No.1009 of 2016 on the file of the Chief Metropolitan Magistrate's Court, Vijayawada, Krishna District for the offence punishable under Section of Negotiable Instruments Act.
Learned counsel for the petitioner/accused would submit that the petitioner has fair chances to success in the impugned C.C. She is a woman and ultimately prayed this Court to dispense her personal appearance in the impugned C.C.
There is a provision under the Code of Criminal Procedure to file an application and seek dispensation of personal appearance as and when it is difficult to the parties to attend the criminal Court. Whenever it is difficult to the petitioner, she may choose to invoke the provision under Section 317 Cr.P.C. Whenever such application is filed, the Court may consider the same in accordance with the law.
With the above observation, this Criminal Petition is disposed of.
The Miscellaneous Petitions, if any, pending shall stand closed.
