HON'BLE SRI JUSTICE S.V. BHATT Writ Petition No.25047 of 2017 ORDER:
Heard Mr. P. Raja Sripathi Rao for petitioner, Assistant Government Pleader (Revenue) for respondents 1 to 4 and Sri M. Sree Rama Rao for 7th respondent.
2. The petitioner, in the statutory appeal filed against the proceedings D.Dis.E.C.No.428540/ 2016(B) dated 16.12.2016, has stated that the change of conversion of agricultural lands into industrial is likely to affect the life and livelihood of farmers in the neighbourhood. By reference to the conversion of land from agriculture to industrial, if the 7th respondent changes physical features, then petitioner would be subjected to prejudice at large. Hence, the present writ petition is filed for a direction to the 2nd respondent to consider the appeal dated 10.04.2017 expeditiously and dispose of the same.
3. The Assistant Government Pleader (Revenue) and Sri M. Sree Rama Rao, do not oppose the prayer. Hence, I am satisfied, the writ petition can be disposed of by this order.
a) The petitioner is given liberty to file copy of this order along with a Memo before the 2nd respondent and seek a date for hearing of appeal within two weeks from the date of receipt of a copy of this order;
b) The 2nd respondent on receipt of such Memo considers disposing of the appeal within two months thereafter.
c) The 2nd respondent issues notice of hearing to petitioner and 7th respondent and if necessary calls for a report from respondents 4 and 5 and disposes of the appeal.
4. The writ petition is, accordingly disposed of. No order as to costs. Pending miscellaneous petitions if any in this writ petition shall stand dismissed in consequence.
