THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.3469 of 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Criminal Procedure Code by the petitioners/A2 & A3 in Crime No.607 of 2022 of Rajendranagar Police Station, Cyberabad Commisionerate, registered for the offences punishable under Sections 376(2)(k)(n), 312 & 201 of Indian Penal Code. 2.

The case of the prosecution is that accused No.1 indulged in sexual intercourse with the victim and thereafter cheated her. For the said reason of cheating, she became pregnant and she filed complaint against A1. During the course of investigation, the police arrested A1 and in the confession of A1, A1 stated that he took the assistance of A2 and A3 to take the victim to the hospital where she was to undergo clinical tests and other procedure for the purpose of terminating the said pregnancy. Other than the allegation of helping the victim to proceed to the hospital, there are no other allegations against the petitioners/A2 and A3. 3.

In the said circumstances, the petitioners can be released on bail on the following conditions.

i. the petitioners/A2 & A3 are directed to be released on bail on their executing personal bonds for Rs.20,000/- (Rupees Twenty Thousand only) each with two sureties

each for a likesum, to the satisfaction of the XIV Additional Metropolitan Magistrate, Cyberabad, Rajendranagar.

ii. After release on bail, the petitioners/A2 and A3 shall appear before the Investigating Officer on every Sunday between 10.00 a.m to 5.00 p.m., for a period of two months or till filing of the charge sheet whichever is earlier.

iii. The petitioners/A2 & A3 shall comply with the conditions as laid down under Section 437 (3) of Cr.P.C. Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any, pending shall stand closed.
