THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.8853 OF 2016 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India for the following relief:

"to issue a Writ, Order of Direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in not providing an employment to the petitioner as Contract Labourer in terms of G.O.Ms.No.98 Irrigation (PW) Department dated 15.08.1986 as illegal, arbitrary, violative of Articles 14, 21 of the Constitution of India and consequently direct the respondents to consider the representation dated 31.12.2015 of the petitioner for appointment as Contract Labourer in the respondent corporation and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

2. Heard Sri I.V.Radhakrishna Murthy, learned counsel, appearing for the petitioner and Smt. K.Udaya Sri, learned standing counsel, appearing for the respondents.

3. When the matter is called, it is represented by the learned counsel for the petitioner that for redressal of the grievance of the petitioner, petitioner herein submitted a representation dated 31.12.2015 to the 4th respondent herein and no action has been taken so far on the said representation. It is further requested by the learned counsel that the said representation may be directed to be disposed of by the 4th respondent, in accordance with law, by fixing some timeframe.

4. For the aforesaid reasons, Writ Petition is disposed of, without expressing any opinion on the merits and demerits of the matter and entitlement of the petitioner, directing the

4th respondent herein to take action and pass appropriate orders on the representation dated 31.12.2015 said to have been submitted by the petitioner herein, in accordance with law, within a period of two months from the date of receipt of a copy of this order.

5. Miscellaneous petitions pending consideration, if any, in the Writ Petition shall stand closed in consequence. No order as to costs. __________________ A.V.SESHA SAI, J 17.03.2016 SS
