No representation on behalf of the petitioner on 03.04.2017. On 05.06.2017, as there was no representation for the petitioner, the matter was directed to be listed on 06.06.2017, under the caption 'for dismissal'. Even today, there is no representation on behalf of the petitioner, inspite of the matter being listed under the caption 'for dismissal'.

Heard learned Government Pleader for Home.

The present writ petition came to be filed seeking issuance of writ of Mandamus declaring the action of respondent No.3 in calling the petitioner to respondent No.3 police station under the guise of investigation in Crime No.421 of 2016, as illegal and arbitrary. 4.

Learned Government Pleader for Home, on instructions, submits that though the name of the petitioner is not shown as accused, but the statement of witnesses recorded by the police during the course of investigation throw a needle of suspicion against the petitioner in the above crime, registered for the offences punishable under Sections 320 and 201 read with Section 34 of IPC. She further submits that on only one occasion, the petitioner was called to the police station for enquiry.

Having regard to the above circumstances, the writ petition is disposed of directing respondent No.3 not to interfere with the life and liberty of the petitioner under the influence of respondent No.4, except

CPK, J W.P.No.9277 of 2017 in accordance with law. Further, if the petitioner is shown as accused, respondent police are at liberty to take steps in accordance with law. No costs.

As a sequel thereto, Miscellaneous Petitions, if any, pending in this Writ Petition, shall stand closed.
