THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION NO.13367 OF 2019 ORDER:

The petitioners filed this Writ Petition with the following prayer:- "...to issue a Writ, order or direction, one more particularly in the nature of any writ of Mandamus declaring the action of the 2nd respondent in not considering the proposals submitted by the petitionerinstitution for the block period of 2019-20 to 2021-22 as irrational, arbitrary, unconstitutional, apart from being in violation of the law laid down by the Hon'ble Supreme Court of India and the provisions of Telangana Educational Institutions (Regulation of Admission and Prohibition of Capitation Fee) Act, 1983 and the Telangana Admission and Fee Regulatory Committee (for Professions Courses offered in Private unaided Professional Institutions),Rules 2006 and set aside such action; consequently direct the 2nd respondent to notify and fix the fee for the petitionerinstitution for the block period of 2019-20 to 2021-22 before the Counselling process begins, i.e., before 05.07.2019; and pass such other order or orders as the Hon'ble Court may deem fit and proper in the circumstances of the case."

Mr. A. Abhishek Reddy, learned Standing Counsel appearing on behalf of R-2 to R-5, submits that since the respondents have undertaken the procedure to fix the fee of the petitioner-institution for the block period 2019-20 to 2021-22, no further orders are necessary in this Writ Petition.

The same is not disputed by counsel for the petitioners. Recording the said submission, the Writ Petition is disposed of. However, it is open for the petitioners to agitate their rights against the procedure adopted by the second respondent if it is still

aggrieved. There shall be no order as to costs. Miscellaneous applications, if any, pending shall stand closed. ______________________________ (A.RAJASHEKER REDDY, J) 3rd July 2019 RRB
