HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No. 5921 OF 2017 ORDER:

This writ petition is filed seeking writ of mandamus declaring the endorsement No. Rev-ESECOLEA(EVC)/232/2016DYTAH(E6)REVCTTR, dated 30.11.2016 issued by the 2nd respondent without considering the assignment/alienation of the land in Sy.No.743/1 to an extent of Ac.0.68 cents in Mittapalem Revenue Village, Chandragiri Mandal, Chittoor District, without considering the report of the 4th respondent dated 22.03.2010 as directed by this Court in WP No.25653 of 2008, dated 24.06.2014 as illegal and arbitrary and consequently to set aside the same and also to direct the 2nd respondent to consider the application of the petitioners dated 15.05.2008 afresh in accordance with Board Standing Orders.

During the pendency of this writ petition, the petitioners filed W.P.M.P.No.7937 of 2017 for impleading the Chief Commissioner of Land Administration (Appeals) as 5th respondent, as revision filed by them against the impugned proceedings of the 2nd respondent, is pending with the 5th respondent. The said application is allowed today by allowing the impleading of 5th respondent in the writ petition. Heard learned counsel for the petitioners and learned Assistant Government Pleader for Revenue.

Learned counsel for the petitioners submits that in I.A.No.412 of 2016 in O.S.No.191 of 2016 filed by the petitioners before the III Addl. District Judge, Tirupati, ad-interim injunction was granted and that in the said suit, Government is also a party.

Learned Assistant Government Pleader for Revenue submits that the petitioners are not in possession of the subject land. Since the revision filed by the petitioners against the impugned proceedings of the 2nd respondent dated 30.11.2016 is pending before the 5th respondent, without expressing any opinion on the merits of the case, the 5th respondent is directed to dispose of the revision filed by the petitioners against the impugned proceedings within a period of eight weeks from the date of receipt of a copy of this order. Till passing of final orders, status quo obtaining as on today shall be maintained by both parties.

With the above direction, the writ petition is disposed of. There shall be no order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
