THE HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No.17586 of 2004 ORDER:

Petitioner challenges the proceedings Rc.No.30890/2004-Legal (MACS) dated 23.09.2004.

2. Through the impugned proceedings, the first respondent purporting to exercise his jurisdiction under Section 29(2) of the AP Mutually Aided Cooperative Societies Act, 1995 appointed the Joint Registrar (DCO), Visakhapatnam to conduct enquiry into the alleged violation of statutory provisions of APMACS Act by the petitioner society and submit report.

3. Mr. P.B. Vijay Kumar submits that on 29.09.2004 the proceedings, impugned in the writ petition, were suspended and the petitioner after passing the resolutions within the four corners of law, has got the petitioner society converted into producer company on 06.01.2006 in terms of the Companies Act, 1956.

The submissions are placed on record and the writ petition is disposed of as no further order is necessary. As a sequel, the miscellaneous applications, if any pending, shall stand closed. There shall be no order as to costs.
