THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.7920 of 2015 ORDER:
This petition is filed under Section 482 Cr.P.C. seeking to quash the proceedings against the petitioners/accused Nos.2 to 5 in C.C.No.326 of 2015 on the file of III Additional Chief Metropolitan Magistrate, Hyderabad.
Heard Sri Vempati Mallikarjuna Shastry, learned counsel for the petitioners, Sri C.Srinivas, learned counsel for the second respondent and the learned Public Prosecutor, representing the State.
At the time of arguments, learned counsel for the petitioners has sought permission of this Court to permit the petitioners to withdraw the criminal petition with a liberty to avail the remedies available to them under law including filing of petition under Section 70(2) Cr.P.C. to recall the warrants. He further submits that the presence of the petitioners/accused Nos.2 to 5 before the trial Court may be dispensed with on each and every date of adjournment.
Permission is granted. Accordingly, the Criminal Petition is dismissed as withdrawn with a liberty to the petitioners to avail all the remedies available to them under law including filing of a petition under Section 70(2) Cr.P.C. to recall the warrants. If the petitioners file the petition under Section 70(2) Cr.P.C., the trial Court is hereby directed to dispose of the same on the same day in accordance with law.
Consequently, Miscellaneous Petitions, if any, pending in
this Criminal Petition shall stand closed.
