Heard the learned counsel for petitioners and the learned Government Pleader for School Education for respondents.
2. The petitioners, who are wife and husband, claim to be providing Mid Day Meal to the school children of Zilla Parishad High School and Praja Parishad Primary School, situated at Rangannapatedda, H/o. Pantrangam Village, Sullurupeta Mandal, S.P.S.R. Nellore District from 20.12.2003 onwards. When the Headmaster was interfering with the Programme, a compliant was lodged against him and some disputes arose in that connection. When the respondents wanted to associate two more persons with the petitioners for provision of Mid Day Meal, the present writ petition was filed.
3. The learned counsel for petitioners submits that the association of two more persons with the existing suppliers would create problems and it is not in the interest of students. Though a counter affidavit was filed by the second respondent, in view of allegations leveled against him by the petitioners which culminated in association of additional persons, the learned counsel for the petitioners submits that the said counter-affidavit shall not be taken into consideration.
4. This Court earlier directed the learned Government Pleader to get instructions whether the petitioners are continuing to supply the Mid Day Meals or not. The learned Government Pleader, on the basis of instructions, submits that the petitioners are continuing as on today. Though the newly appointed persons were made parties, none represented them.
5. When the petitioners are continuing to supply the Mid Day Meals
as on today, no further orders need be passed in the present writ petition disturbing the existing arrangement by the petitioners and it is accordingly closed. No order as to costs. Miscellaneous Petitions pending, if any, shall stand closed.
