THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO. 3471 OF 2022 O R D E R:

This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C.") seeking pre-arrest bail to the petitioner/Accused No.10 in the event of his arrest in connection with Crime No.598 of 2021 on the file of Station House Officer, Ramachandrapuram Police Station, Cyberabad registered for the offences punishable under Sections 419, 420, 406, 467, 468 and 471 of Indian Penal Code (I.P.C.) 2.

Heard the learned counsel for the petitioner/Accused No.10 and the learned Assistant Public Prosecutor for the respondentState. Perused the record. 3.

The allegation against the petitioner/Accused No.10 is that, the petitioner/Accused No.10 who is representative of R.K.Media Promotions has taken loan amount of Rs.2,00,00,000/- (Rupees Two Crores) in the year 2017, thereafter, for nonpayment, the bank went and filed O.A.No.17 of 2020 before the DRT-1, Hyderabad seeking recovery of the loan amount.

Learned counsel for the petitioner submits that one of the properties were also put up for auction by the bank. 5.

The crime came to be registered on 02.08.2021, however, the petitioner was never taken into custody by the police though he was available at his residence and office premises. The petitioner undertakes to assist the investigation in whatever manner required. 6.

In the said circumstances, this court is inclined to grant Anticipatory Bail to the petitioner/Accused No.10. 7.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused No.10 is granted anticipatory bail subject to the following conditions:

i) The petitioner/Accused No.10 is directed to surrender before the Station House Officer, Ramachandrapuram Police Station, Cyberabad, within one week from the date of the order, and on such surrender, the said Station House Officer shall release the petitioner/Accused No.10 on bail on his executing a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh Only) with two sureties to the like sum each to his satisfaction.

ii) The petitioner/Accused No.1 shall appear before the Station House Officer concerned on every day between 10.00 AM and 01.00 PM for the first month and on every Monday and Thursday between 10.00 AM and 01.00 PM for the next two months. iii) The petitioner/Accused shall abide by the other conditions stipulated in Section 438(2) Cr.P.C.

As a sequel thereto, miscellaneous applications, if any pending, shall stand closed.
