THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.9754 OF 2016 ORDER:

This criminal petition under Section 482 of the Code of Criminal Procedure is filed by the petitioners/A.28 to A.32 seeking to relax the condition imposed by order dated 30.05.2016, in Crl.M.P.No.706 of 2016 passed by the III Additional Sessions Judge, Rajampet, whereby the Court below imposed the condition that "the petitioners shall be released on their executing a self bond for Rs.50,000/- each with two local sureties for the like sum each". Heard and perused the records.

Learned counsel for the petitioners/A.28 to A.32 submits that the petitioners are native of Tamil Nadu State and as such they could not able to secure the two local sureties. He further submits that they are unable to secure sureties for Rs.50,000/-. Hence, he prays this Court to reduce the surety amount and also relax the condition of producing two local sureties. Considering the facts and circumstances of the case, Para 9(1) of the order, dated 30.05.2015, in Crl.M.P.No.706 of 2016 is modified as under. "The bail application of the petitioners/A.28 to A.32 is allowed and A.28 to A.32 are ordered to be released on bail on their executing a self bond for Rs.20,000/- each with two sureties, out of which, one surety shall be native of State of Andhra Pradesh, and one surety shall be native of State of Tamil Nadu, to the satisfaction of the learned Judicial First Class Magistrate, Railway Kodur." The Criminal Petition is accordingly allowed. _____________________ JUSTICE RAJA ELANGO 13.07.2016 pln
