Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Prohibition & Excise for the State of Andhra Pradesh. At the request of both the counsel, the Writ Petition itself is taken up for disposal at the stage of admission.
2. The present Writ Petition came to be filed challenging the order dated 04.09.2015 in Rc.
No.117/2014/A1 passed by respondent No.3 ordering confiscation of TATA Sumo vehicle bearing Registration No.AP27TV 0500 involved in Cr. No.16/2014-15 of Prohibition & Excise Station, Badvel.
3. A perusal of the order dated 04.09.2015 shows that inspite of service of show-cause notice on 04.04.2015, owner of the vehicle failed to submit explanation. Therefore, after considering the material on record, respondent No.3 ordered confiscation of the vehicle viz. TATA Sumo vehicle bearing Registration No.AP27TV 0500 involved in Cr. No.16/2014-15 of Prohibition & Excise Station, Badvel. Admittedly, against the said order, an appeal lies to respondent No.2 within 60 days from the
date of receipt of a copy of the said order. When the same is pointed out, learned counsel for the petitioner seeks time to prefer appeal before the authority concerned, in which event, the same shall be dealt with in accordance with law as early as possible.
4. The Writ Petition is disposed of with the aforesaid direction. Miscellaneous petitions pending, if any, in the Writ Petition shall stand closed in the light of this final order. No order as to costs.
